These Terms of Service ("Terms") govern your use of the Doneo mobile application ("App") operated by Masayuki Yamada ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
Doneo is a productivity application that provides a Pomodoro-style focus timer with gamification elements (XP, levels, streaks) and optional diary functionality. The App may also include features such as leaderboards, account synchronization, subscription-based premium features, speech-to-text diary input, nightly reminders, and focus-mode app blocking, which may be introduced in future updates.
You must be at least 13 years old (or 16 in the EEA) to use the App. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have your parent or legal guardian's consent to use the App and that they have read and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these requirements.
Certain features (such as data synchronization, device transfer, and leaderboards) may require you to create an account using Sign in with Apple, Sign in with Google, or another authentication method we may support. You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.
You may delete your account at any time through the App settings or by contacting us at doneoapp@gmail.com. We may suspend or terminate your account if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users or the service. Upon termination, your server-stored data will be deleted in accordance with our Privacy Policy.

Diary entries and display names you create in the App are considered user-generated content ("User Content"). You retain ownership of your diary entries. By using the App, you grant us a limited, non-exclusive, royalty-free license to store, process, and synchronize your User Content solely for the purpose of providing and improving the service. Diary entries are private by default and are not shared with other users unless you explicitly choose otherwise. We reserve the right to remove display names that violate our acceptable use policy.
The App is free to download and use with advertisements. Premium features (such as ad removal, speech-to-text diary, and app blocking) may be offered through paid subscription plans.
Subscription purchases are processed through Apple's App Store or Google Play. By purchasing a subscription, you agree to the respective platform's payment terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's subscription settings (iOS: Settings > [Your Name] > Subscriptions; Android: Google Play > Subscriptions).
We may offer free trial periods for premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the posted rate.
Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly. Please contact the respective platform for refund requests.
We may change subscription prices at any time. Price changes will not affect your current billing period. You will be notified of price changes in accordance with the requirements of the applicable platform before your next renewal.
If you participate in leaderboard features, your configurable display name and performance data (XP earned, focus time) will be visible to other users. Your display name can be changed in the App settings; anonymous display is the default. We reserve the right to remove users from leaderboards or reset their scores for violations of these Terms, including manipulation of rankings.
The App, including its design, code, graphics, animations, sounds, XP/level system, and all associated intellectual property, is owned by Masayuki Yamada and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App or any part thereof without our prior written permission. "Doneo" and associated logos are trademarks of Masayuki Yamada.
The free version of the App displays advertisements provided by Google AdMob. Ad content is determined by Google and is not controlled by us. By using the free version, you acknowledge and consent to the display of advertisements. You may remove ads by subscribing to a paid plan when available.
The App may offer a feature that reminds you to return to your focus session when you switch to other apps. This feature requires Screen Time (iOS) or Usage Stats (Android) permissions and operates within the constraints set by the operating system. This feature is advisory only -- it does not forcibly block app access or override system functionality. We are not responsible for any consequences of using or not using this feature, including missed calls, messages, or notifications from other apps during focus sessions.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DO NOT GUARANTEE THAT:
Some jurisdictions do not allow the exclusion of certain warranties. In such cases, the above exclusions apply to the fullest extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR LOSS OF STREAKS/XP DUE TO TECHNICAL ISSUES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Masayuki Yamada from and against any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your violation of these Terms; (b) your misuse of the App; (c) your User Content; or (d) your violation of any rights of a third party.

We may remove or disable access to material that is alleged to be infringing and may terminate the accounts of repeat infringers in appropriate circumstances.
The App integrates with third-party services (Google AdMob, Apple/Google payment processing, authentication providers, analytics services). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.
We reserve the right to modify, update, suspend, or discontinue the App (or any feature thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App. If we discontinue a paid feature during your active subscription period, we will provide a pro-rata refund or equivalent remedy where required by applicable law.
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or on our website at least 14 days before the changes take effect. Where required by law, we will obtain your consent to material changes. Continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the App.
These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court (Tokyo, Japan) as the court of first instance. This choice of jurisdiction does not deprive consumers of the protection afforded by mandatory provisions of the law of their country of residence.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Masayuki Yamada regarding your use of the App. These Terms supersede any prior agreements, understandings, or representations (whether written or oral) regarding the App.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, power failures, internet disruptions, or other force majeure events.
